Terms of Service

These Terms govern your use of InkedByAI ("the service"), an AI tattoo generator operated at inkedbyai.tools. By using the service you agree to these Terms.

1. The Service

InkedByAI is a web-based AI tattoo design canvas. You provide a text prompt or reference image; we run AI generation on your behalf; you receive image outputs in your account gallery. The service is provided on an "as is" basis.

2. Account & Eligibility

• You must be at least 16 years old to use the service.
• You must provide accurate registration information and keep your credentials secure.
• You are responsible for all activity under your account.

3. Your Content & Generated Designs

• You own the prompts and reference images you upload.
• You own the AI-generated designs to ink, share, and use commercially. We claim no royalty and no authorship.
• You grant InkedByAI a non-exclusive license to host, store, and display the generations as needed to operate the service (so the gallery works in your browser, etc.).
• Designs you explicitly publish to the public gallery may be remixed by other users in the canvas.

We disclaim warranties about the uniqueness, copyright clearance, or right-of-publicity of generated designs — see Disclaimers below.

4. Acceptable Use Policy

InkedByAI is built for legitimate tattoo design only. You agree not to use the service to generate, upload, or distribute content that:

Sexual / explicit content (zero tolerance):

• depicts child sexual abuse material — instant termination and reporting to law enforcement where applicable;
• is sexually explicit, pornographic, nude, or sexually suggestive in any form;
• attempts to circumvent content filters via jailbreak prompts, encoded prompts, multi-step prompt injection, or any obfuscation technique.

Identity / likeness:

• generates face-swap, deepfake, or non-consensual likeness of real persons;
• generates content depicting identifiable minors in any inappropriate context.

Harm / abuse:

• promotes violence, self-harm, gore, harassment, or hatred against persons or protected groups;
• is intended to deceive or defraud (including fake "real" tattoos for fraudulent purposes).

Rights infringement:

• infringes third-party copyright, trademark, or right of publicity;
• attempts to reverse-engineer the model, scrape outputs at scale, or resell raw API access.

Enforcement. Every text prompt submitted for image generation is screened by an automated content moderation provider (Creem Moderation API) before it reaches the AI model. Prompts that violate this policy are blocked at the moderation layer; repeated attempts result in account termination. We are fully responsible for content this platform enables and reserve the right to enforce this policy at our sole discretion.

Reporting. If you encounter content on InkedByAI that violates this policy, email support@inkedbyai.tools.

5. Credits & Billing

InkedByAI is billed by credits. Each generation consumes credits; tier names, credit amounts, included features, and prices are listed on the pricing page. Specific charges are disclosed at checkout before you confirm payment.

We offer two purchase models, both shown on the pricing page:

Pay-as-you-go credit packs (one-time purchase)

• A one-time payment for a fixed number of credits. There is no subscription, no auto-renewal, and no recurring charge for these packs.
• Credits are delivered to your account immediately on successful payment.
• Pay-as-you-go credits do not expire — they remain on your account until you spend them or close the account.

Creator subscription (recurring)

• A recurring monthly charge that grants a fixed allotment of credits at the start of each billing period, plus subscriber-only benefits described on the pricing page.
• Subscription credits reset at the end of each billing period and do not roll over to the next month.
• Your subscription renews automatically until you cancel it. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period, and you keep access until then.
• If you also have a pay-as-you-go credit balance on the same account, your pay-as-you-go credits remain on the account separately and follow the non-expiry rule above.

We may add new tiers or adjust pricing. Any change applies to new purchases and the next renewal period only, and does not affect credits already on your balance or the price of an in-progress billing period.

6. Refunds

Pay-as-you-go credit packs. Credit packs are non-refundable digital goods. Once credits are added to your account they are considered delivered, and we do not refund unused or partially used balances.

Creator subscription. You can cancel at any time, which stops the next renewal. We do not pro-rate or refund the current billing period once it has started, because the credits for that period have already been delivered to your account.

EU / consumer-protection carve-out. If applicable consumer-protection law in your jurisdiction grants a non-waivable right to cancel a distance-contract purchase (such as the EU 14-day cooling-off right under the Consumer Rights Directive), that right applies and overrides the clauses above. Note that under the same Directive, the cooling-off right for digital content is lost once you have expressly consented to immediate access and acknowledged that the right will be lost — which happens implicitly when you generate your first design with newly purchased or newly issued credits.

Errors and double-charges. Charges made in error, double-charges, or charges for credits that were not delivered to your account will be refunded in full on request — email support@inkedbyai.tools with your transaction ID.

Response time. We respond to all refund and billing support requests within 3 business days.

7. AI Output — Disclaimers

The service runs third-party AI models. We do not guarantee:

• that any generated design is unique, copyright-clear, or free of incidental likeness to existing work;
• that a design is suitable for any specific skin, placement, scale, or healing outcome;
• that a design will look the same when applied as a tattoo as it does on screen.

Tattoo decisions are yours. The on-screen draft is a creative reference; final stencil work and skin-appropriate composition should be done with a licensed tattoo artist.

8. Service Availability

We aim for the service to be reliably available but do not commit to a specific uptime. We may schedule maintenance, update model providers, or modify features at any time. We will not materially reduce paid functionality without notice.

9. Termination

You can stop using and delete your account at any time. We may suspend or terminate accounts for material breach of these Terms (notably Acceptable Use), repeated copyright violation, or payment fraud. We will notify you when reasonable.

10. Limitation of Liability

To the fullest extent permitted by law, InkedByAI's aggregate liability under these Terms is limited to the amount you paid in the 12 months preceding the claim, or USD 50, whichever is greater. We are not liable for indirect, incidental, or consequential damages, including any tattoo outcome.

11. Governing Law

These Terms are governed by the laws applicable to InkedByAI's operating jurisdiction. Any dispute will be resolved in the appropriate venue under that law, without prejudice to any non-waivable consumer-protection rights you have under the law of your country of residence.

12. Changes to These Terms

We may update these Terms as the service evolves. Material changes will be communicated by email to active accounts before they take effect. Continued use after the effective date constitutes acceptance.
