Privacy Policy

This Privacy Policy explains how InkedByAI ("we", "us") collects, uses, and protects the information you provide when you use the AI tattoo generator at inkedbyai.tools.

By using the service you agree to this policy.

1. Information We Collect

• Account information — name, email address, and authentication identifier (e.g. Google sign-in subject ID) you provide on sign-up.
• Generated content — the prompts and reference images you submit, the style / placement choices you make, and the AI-generated tattoo designs returned to your account.
• Usage telemetry — feature interactions, page views, and timing data, kept de-identified and aggregated for product improvement.
• Device and browser — user-agent, screen size, locale, and connection info, used for rendering and debugging.
• Cookies — strictly-necessary cookies for authentication and theme / locale preferences. We do not run advertising cookies.
• Payment information — handled by our payment processor; we receive your transaction history, current credit balance, and invoice IDs but never the full card number.

2. How We Use Your Data

• Operate the AI tattoo generator (run generations, store outputs to your gallery)
• Bill subscriptions and credit packs (see pricing for current plans)
• Send transactional email about your account, billing, and material policy changes
• Improve the model selection logic and the canvas UX, using aggregated and de-identified data only

We do not use your private prompts or generated designs to train AI models. Designs you explicitly publish to the public gallery may be visible to other users.

3. Third-Party Sub-Processors

We share the minimum data needed with vetted sub-processors:

• AI inference providers (e.g. Replicate) — receive your prompt and any reference image for the duration of the generation call only.
• Content moderation (Creem Moderation API) — receives the text portion of your prompt before each image generation, in order to enforce the Acceptable Use Policy. The moderation provider does not retain prompts after the decision is returned.
• Object storage (Cloudflare R2) — stores the generated image files served back to your gallery.
• Hosting (Vercel) — runs the application and serves all pages.
• Database (Turso / libSQL) — stores account, billing, and gallery metadata.
• Payment processor — handles checkout and recurring billing; see the processor's own privacy policy disclosed at checkout.
• Transactional email (e.g. Resend) — delivers account, billing, and security emails.

We disclose information to authorities only where required by applicable law.

4. Your Rights

Depending on your jurisdiction (including GDPR for EU/UK residents and CCPA for California residents), you may have the right to:

• access the personal data we hold about you,
• correct inaccurate data,
• export your data in a portable format,
• delete your account and associated data,
• object to or restrict certain processing.

Email support@inkedbyai.tools to exercise any of these. We respond within 30 days.

5. Data Retention

• Generated designs — kept until you delete them or close your account.
• Account data — purged 30 days after account closure.
• Billing records — retained for the period required by tax law in the operating jurisdiction (typically up to 7 years).
• Logs and telemetry — rotated within 90 days.

6. Security

All traffic is served over HTTPS. Secrets are encrypted at rest. Admin tooling is protected by role-based access. No system is fully invulnerable; if an incident materially affects your data we will notify you within the timeline required by applicable law.

7. Children

InkedByAI is not directed to children under 16 and we do not knowingly collect data from anyone under 16. If you believe a child has provided data, contact us and we will delete it.

8. International Transfers

Your data may be processed in jurisdictions outside your country of residence (notably where our hosting and inference providers operate). We rely on standard contractual clauses or equivalent legal mechanisms where required.

9. Changes

We will post any update to this page and bump the Last updated date. Material changes will be communicated by email to active accounts before they take effect.
